Privacy Notice

This Privacy Notice (“Notice”) is distributed to you by Establishment Labs® S.A., having its registered address at Coyol Free Zone, B15, Alajuela, Costa Rica, (“ESTA”, “we”, “us”), together with European Distribution Center Motiva BV, having its registered address at Nijverheidsstraat 96, 2160 Wommelgem, Belgium, VAT BE 0881.512.541 RPM/RPR Antwerp (“EDC”), which processes data with ESTA as data controller if you are located in the EU and acts as ESTA’s representative in the EU.  This Notice covers the personal data that ESTA and EDC collect through motiva.health and other websites (establishmentlabs.com, miafemtech.com) (individually, “Website” or collectively “Websites”), applications, products, and services owned or controlled by ESTA, EDC, and our affiliates (collectively referred to as “Affiliates”) or Websites that post a link to this Notice.  Personal data means information, either with other information or by itself, that allows you to be directly or indirectly identified (“Personal Data”).

This Notice is to inform you how we collect, use, disclose, and store Personal Data in our role as a controller of Personal Information when you:

  • Interact with our websites, including when you download information.
  • Provide your personal data to allow administration of our services and managing our relationship with you (“Services”), such as setting up a website or app account or collecting data to process an invoice for accounting purposes.
  • When you explicitly consent to provide health data for warranty registration or product support (“Products”), such as attending physician, implant or tool serial numbers, date of purchase, and surgery details.
  • Register and/or attend one of our events, webinars, live events, or conferences (collectively “Events”).

 

What Personal Data does ESTA collect?

 

Data you provide to us

We may collect Personal Data that you choose to provide us when accessing or using our websites, such as when you register for an online account or contact us via our websites.  If you do contact us, a record of our correspondence will be maintained.

We receive and store Personal Data you explicitly agree to provide to us for Products, such as when you register your implants for a warranty program or product support.  This data may include name, address, procedure information, attending surgeon, implant serial numbers, and other required procedure information.

When you use our Services or Events, we store the Personal Data you provide including name, email address, or other contact information.  We retain records of our communication.

You may refuse to provide requested information anywhere on our Websites or App, but if you refuse, we may not be able to provide you the requested services relating to the creation of your account, the registration of your implants, or your participation in any benefits.

 

Automatic Data Collection

Websites:

Subject to your tracking preferences, ESTA may use a variety of technologies, like trackers and cookies, that collect and provide information about how our Websites or Apps are accessed and used. Such information may consist of your internet browser, operating system, service provider, the webpages you viewed, the time you viewed them and for how long, and demographic information.

Services:

When you use the Services, network data may also be collected.  The data could include log information about users (including IP addresses), usage information (types of services users use, performance metrics, and computer configurations), and data collected by cookies or similar technology.

Information we collect from trusted third parties:

If your Personal Information has been collected as (i) you interacted or used our Website, (ii) you registered and/or attended our Events, and/or (iii) part of the Services, your Personal Information, as stored in our CRM service provider, may be enriched or updated to ensure it is accurate and up to date, and achieves the purpose for which it was originally collected. Please note that the information used to enrich and update your Personal Information, as obtained from the use of third parties’ data sets, does not constitute Personal Information, but merely amounts to data elements related to your organization’s name, structure, industry, and similar attributes.

Please note that we may also obtain non-personal information for the purpose of enriching or updating your Personal Information we already hold.

 

How and on which legal bases do we use your Personal Data?

 

Personal information we collect from you on our Websites, Products, or Events:

  • To customize the website according to your interests.
  • Set up a user account.
  • To improve our websites to make sure it is presented most effectively for you and your device.
  • To perform marketing, advertising, improve products and services, conduct surveys or trend analysis.
  • To perform internal operations such as data analysis, testing, troubleshooting, survey, and statistical purposes.
  • To help keep our websites secure.
  • To contact you by email, phone, fax, or mail for medical research purposes.
  • To register your implants via your account, including internal record keeping, customer services, and responding to your requests about your Products.
  • To allow your participation in our warranty or insurance programs to which you subscribe.

Our use of Personal Data may be based on our legitimate interests to ensure security, business performance improvement, and network operations.  Our legitimate interests may also be relied upon to improve business and marketing practices or contact you to offer similar Services or products that you may have bought from us.  Direct marketing purposes are based upon your consent.

The use of Personal Data for product registration, warranty, or insurance programs may be based on our performance of a contract with you and your explicit consent to use this data in performance of the contract.  Provision of personal data in these instances is necessary to enable our proper execution of the warranty, insurance program, and to register your implants, system, or tools.  Without your permission it may be excessively difficult, or impossible, to accurately obtain data to verify dates of implantation of your implant(s).

 

Personal information we collect from you through administration of our Services:

  • Send customers technical alerts, updates, security notifications, and administrative communications.
  • Process and complete transactions, and send related information, including transaction confirmations and invoices.
  • Investigate and prevent fraudulent activities, unauthorized access to the Services, and other illegal activities.
  • Manage our customers’ use of the Services, respond to inquiries and comments, and provide customer service and support.
  • For any other purposes about which we notify customers and users.
  • Cookies: When users access our Websites or Apps we use strictly necessary cookies and other trackers to provide authentication tools, enhance security, and prevent fraud. For more information about our use of cookies and other trackers visit the ESTA Cookie Notice.

We may rely upon on our legitimate interests for use of your Personal Data in these contexts, generally, either for security purposes or for business improvement, such as investigating and preventing fraudulent activities.

Provision of Personal Data in these instances may be needed to enable access to some of the Services.  If you choose to not provide Personal Data, you may experience the unavailability of some Services.

 

Enterprise Data Analysis:

If your Personal Data has been collected (i) directly from you through our Websites, Products, or Events, and/or (ii) part of the administration of our Services, your Personal Data may be used for the purposes of enterprise data analysis, depending on the scope and purpose of the analysis.

 

How we may share Personal Data to third parties.

 

When required to achieve the purposes outlined previously, ESTA and/or EDC may share Personal Data in the following limited circumstances:

 

Between our affiliates:

We may share your Personal Data within our family of companies, including ESTA, EDC, and other affiliates of our organization for purposes consistent with this Notice and based on our legitimate interests.

 

Protection of ESTA, EDC, and others:

We reserve the right to access, read, preserve, and disclose any Personal Data as necessary to i) comply with a law or a court order, ii) enforce or apply our Agreements with you and other agreements, or iii) protect the rights, property, or safety of ESTA, EDC, our affiliates, our employees, our users, or others.

 

Disclosures for national security or law enforcement:

Under certain circumstances, we may be required to disclose your Personal Data in response to valid requests by public authorities, including to meet national security or law enforcement requirements, based on our legitimate interests or legal obligations.

 

Business transfers:

We may choose to buy or sell assets and may share and/or transfer customer information, including Personal Data, in connection with the evaluation of and entry into such transactions and based on our legitimate interests. Also, if we or our assets are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Data may be one of the assets transferred to or acquired by a third party.

 

Vendors, consultants, and other service providers:

We may share your Personal Data with third party consultants, service providers, and other vendors who we utilize to perform tasks on our behalf.  For example, these companies may include service providers related to the web, data storage, advertising, or analytics services to us so that we can administer web servers and store information on a secure database or on back-up disks.

If we transfer your Personal Data to a service provider or third party for processing, ESTA remains responsible for ensuring that such third-party agent or service provider processes your Personal Data to the standard required by the applicable privacy laws, including the GDPR.  These transfers are generally based on our legitimate interests.  Please see the International Data Transfers section below for more information.

 

How long we may keep personal data

Your personal data will be kept for different time periods based on the purposes identified herein.  Some Personal Data may be deleted automatically based on specific schedules, such as marketing information.  Other information, such as account information, may be retained for longer as required to comply with contracts with you.  Finally, we may further retain data based on our legitimate interests or legal purposes, such as record-keeping, applicable law(s), or enforcing legal rights.

 

Security

 

We are committed to ensuring that your personal data is secure. In order to prevent accidental or unlawful destruction or accidental loss, misuse, unauthorized access, disclosure, alteration, or destruction, we employ a variety of security measures.

However, please note that no company can guarantee complete security. Therefore, despite the security measures that we have put in place to protect personal data about you, we cannot guarantee that loss, misuse, or alteration of data will not occur.

 

What are your Privacy Rights?

 

What choices do I have?

You have a number of privacy rights and you may always opt to not disclose Personal Data to us.  Please note that some data may be needed to register with us or take advantage of some features of our Products or Services.

Right to withdraw consent:

If you have given your consent for any personal data processing activities as described in this privacy policy, you can withdraw this consent at any time. Such a withdrawal will not affect the lawfulness of the processing prior to withdrawal of the consent.

If you withdraw your consent to the use of your health data for the purpose of the performance of an agreement between you and ESTA and/or EDC relating to your subscription to a warranty or insurance programs, such withdrawal will also be understood as a waiver of any right or claim that exists or may exist on any program, warranty, or coverage which may have been granted under the condition of providing the required information.

Marketing communications:

You may opt-out of receiving marketing or promotional communications from us at any time by using the unsubscribe link in email communications or by sending us a request here.  Please note that if you have an account with us and you opt-out of marketing communications that we may continue to send your non-promotional communications (such as service-related communications).

 

Cookies:

You can change your cookie preferences and other trackers at any time by clicking on the cookie icon at the bottom of the screen on all our Websites or Apps.

 

How do I exercise my Privacy Rights?

If you wish to access personal data about yourself or exercise any of the rights listed below, please submit a request to ESTA by using the contact details identified in the “How to contact us” section below. Alternatively, if you are located in the EU, you may also contact EDC at the address mentioned in the Introduction of this Notice, which will then transfer your request to ESTA.

We will review your request and respond as quickly as possible, but please note that we may still use any aggregated and de-identified Personal Data that does not identify a data subject and use your Personal Data, as needed, to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

Right of access:

You have the right to obtain confirmation as to whether your personal data is processed, and, if so, to request access to such personal data as well as other information about such processing that are also contained in this policy.  Before we may provide access, we will first require verification of your identity to help ensure security of the data.

 

Right to rectification:

You have the right to have inaccurate personal data about yourself rectified or completed if it is incomplete.

 

Right to erasure (‘right to be forgotten’):

You have the right to request that we erase your personal data.

 

Right to restriction of processing:

You have the right to request from us that we limit the way we use your personal data.

 

Right to data portability:

You have the right to receive the personal data you provided, in a structured, commonly used, and machine-readable form and to transmit that data to another controller or to have it transmitted directly from us to another controller.

 

Right to object:

You have the right to object, on grounds relating to your particular situation, at any time, to the processing of your personal data and we may have to stop processing your data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims. You have the right to object, at any time, to the processing of your personal for direct marketing purposes.

International data transfers

ESTA is a company that operates globally. Because of this fact, Personal Data from individuals who visit our Websites, use our Products, and/or use our Services or otherwise interact with us may be transferred and accessed from around the world, such as from countries where ESTA, its Affiliates, or our service providers operate.

We will always protect your Personal Data in accordance with this Notice wherever it is processed. ESTA does not voluntarily or actively transfer or disclose our customers’ Personal Data to the government or law enforcement authorities (the “Authorities”) and/or otherwise grant any Authorities access to your Personal Data. In the event of a request from the Authorities, we have procedures and controls in place to make sure that any such request is assessed according to our internal policy on data protection.

 

Information for users in the European Economic Area (“EEA”) or in the United Kingdom (“UK”):

Operating globally, ESTA may transfer Personal Data from the EEA or the UK to the United States, Costa Rica and other countries, including Personal Data we receive from individuals residing in the EEA or the UK who visit our Websites and/or use our Services or otherwise interact with us.

In cases where ESTA may transfer your Personal Data outside the EEA or UK, it relies on:

  • Adequacy Decisions:
    • European Commission, based on Article 45 of Regulation (EU) 2016/679 (GDPR)
    • UK Secretary of State, based on Article 45 of the UK GDPR and Section 17A of the Data Protection Act 2018; or
  • Standard Contractual Clauses:
    • European Commission
    • Information Commissioner’s Office (ICO)

The European Commission and the ICO have determined that the above Standard Contractual Clauses may provide sufficient safeguards to protect personal data transferred outside the EEA and the UK. ESTA performs transfer impact assessments and monitors such transfers to help ensure they maintain a level of protection that is essentially equivalent to the one provided by the European and UK data protection laws.

 

Appendix for Argentina

 

MOTIVA ARGENTINA S.R.L., CUIT 30-71655700-2, domiciled at Av. Leandro N. Alem 882, (CP1001), Ciudad Autónoma Buenos Aires, Argentina (“MOTIVA ARGENTINA”) is responsible for the processing of your personal data and is the controller of such data. Your personal data will be processed for the provision of the Always Confident Warranty, Replacement Policy, the Extended Warranty Program and to contact you with information we deem you will find relevant and/or useful. 

To this end, you hereby provide MOTIVA ARGENTINA with your prior, express and informed consent, under the terms of Section 5 and 6 of the Argentina Data Protection Law No. 25.326 (hereinafter “DPL”) and related regulations, to collect, process and store your personal data – including your sensitive data –in a database of its ownership, for the purposes and effects set forth in the Privacy Policy. 

When providing your personal data, you understand that some data is mandatory in order for MOTIVA ARGENTINA to comply with its legal obligations, while the collection and provision of other data is completely voluntary as it is intended to carry out the relationship and allow you access to certain benefits and programs. The provision of false or inaccurate information may result in MOTIVA ARGENTINA´s inability to provide you with certain benefits, to comply with its legal obligations, or even to begin or continue, the warranty program. 

 You also understand and consent that your personal data may be transferred to countries or jurisdictions that may not have the same level of data protection of that existing in Argentina and, consequently, may offer less protection.  

The Agency of Access to Public Information, in its capacity as the Control Agency of Law No. 25.326, is responsible for dealing with complaints and claims filed by data subjects whose rights are affected by non-compliance with the regulations in force regarding the protection of personal data.

Mr. Ehrhardt joined the Establishment Labs leadership team in April of 2024 after a distinguished career in Plastic Surgery and Dermatology in the U.S. market.  He was most recently VP and General Manager of the U.S. Plastic Surgery and Regenerative Medicine business unit for Allergan Aesthetics, an Abbvie company.  In his 26 plus years at Allergan he held various senior leadership roles such as VP U.S. Commercial Operations, VP of Sales Plastic Surgery & Regenerative Medicine and VP of Sales and Marketing, U.S. Dermatology.  Notably, he was head of Dermatology Sales for the launch of Botox Cosmetic, acquisition and merger of Lifecell into the U.S. Plastic Surgery organization, acquisition and launch of Aczone®, an acne product, and the launch of the Inspira® line of breast implants.   In his role at Establishment Labs, he will be responsible for the commercialization of the Motiva® Femtech line of breast aesthetics devices in both the U.S. and Canada.   He holds undergraduate degrees in Finance and Marketing from the University of Cincinnati and an M.B.A. from Xavier University.

Rosalyn d’Incelli has been a part of Establishment Labs® since May of 2020 as the company’s Head of Clinical and Medical Affairs, bringing to the company over 20 years of medical device experience. In this role, she drives global clinical and medical strategy and execution and leads US Regulatory Affairs. Prior to joining us, she was with Sientra Inc., for 11 years as the Vice President of Clinical and Medical Affairs. She was responsible for US PMA approval, Medical Education, PR, Publications and the company’s scientific content. She represented the company with FDA, media and medical education events and congresses. Preceding Sientra, Ms d’Incelli held similar roles with PMA approvals at Mentor/Johnson & Johnson and Inamed (now Allergan/AbbVie). She holds a BA in communication/market research from the University of California, Santa Barbara, and is board-certified in SoCRA and RAP.

Mr Dada was one of the founding members of the company back in 2004. Salvador initially led the implementation of Establishment Labs® operations in Costa Rica and the successful certification of the Motiva Implants® product family by the European Union and other high-vigilance countries.

In February 2016, he was appointed as our Chief Operating Officer where he led the expansion of the operations to Brazil, Belgium and, in recent years, to several other European countries where direct commercial operations were launched. Due to health issues, he resigned from his position as COO and now serves as Head of Special Projects. Mr Dada served in various engineering roles at Allergan Medical from 2007 to 2009 and in a variety of production and manufacturing roles at Establishment Biotech, S.A. from 2004 to 2006.

He has an undergraduate and licentiate degree in Industrial Engineering from the University of Costa Rica.

He covered the medical device industry as an equity research analyst for over twenty years. Raj has an impressive academic portfolio, including a bachelor’s degree in biology from UC Berkeley, a master’s degree in Physiology from Georgetown University and an MBA from Cornell University.

Notable accomplishments include restructuring the commercial function and transforming the German market. In his current role, Mr. Bilic strategically leads Establishment Labs’ commercial efforts, overseeing both the channel and direct markets and shaping B2B and B2B2C strategies for market leadership. He represents Establishment Labs in the non-U.S. plastic surgery market and drives innovative marketing approaches globally. Robert Langer is an Institute Professor at MIT (there are 13 Institute Professors at MIT; an Institute Professor is the highest honour awarded to a faculty member). His h-index of 232 is the highest of any engineer in history. He has over 1,130 issued and pending patents which have been licensed or sublicensed to over 300 companies. He served as Chair of the FDA’s SCIENCE BOARD (highest advisory board) from 1999-2002.  Langer is one of a very few individuals elected to the National Academy of Medicine, the National Academy of Engineering, the National Academy of Sciences and the National Academy of Inventors.  He is one of four living individuals to receive both the US National Medal of Science and the US National Medal of Technology and Innovation.  In 2015, Dr Langer received the Queen Elizabeth Prize for Engineering.  He has also received the Draper Prize (considered the engineering Nobel Prize), Albany Medical Center Prize, Wolf Prize for Chemistry, Millennium Technology Prize, Priestley Medal (highest award of the American Chemical Society),  Gairdner Prize, Kyoto Prize and the Lemelson-MIT Prize, for being “one of history’s most prolific inventors in medicine”. He holds 29 honorary doctorates including honorary degrees from Harvard and Yale.

Prof. Michael Atlan MD, Ph.D. is currently the chief of the Plastic and Reconstructive Surgery Department at TENON Hospital and a Professor at the Sorbonne Médecine Université.

His main interests are aesthetic breast surgery, breast reconstruction with ADM, free flaps for breast reconstruction, and breast cosmetic surgery (anatomic implants, fat grafting). His areas of expertise include breast implant surface, the evaluation of new devices in plastic surgery, and facial aesthetic surgery.

He is one of the founders of the CAMPUS CHAMPS ELYSEES.

Prof. Ardeshir Bayat is Director of the Medical Research Council Wound Healing Unit and professor at the University of Cape Town, Cape Town in South Africa. He is considered an expert in wound healing, cutaneous repair and skin scarring, with internationally recognised expertise in implant surface technology, fibrosis and capsular contracture. He trained as a surgeon-scientist with a PhD in molecular genetics of fibrosis. He has published extensively in peer-reviewed scientific literature (in excess of 500 articles to date). He is regularly an invited speaker at both national and international tissue repair conferences (over 600 conferences to date) and serves on the editorial boards of several journals.

His team have created and patented novel biomimetic surfaces and continue to work on developing models to understand the process of cell surface interaction/capsular fibrosis and its modulation related to implant surfaces. His investigative work has enabled translation of basic science to therapeutic developments of direct relevance to both cosmetic patients and industry.

Dr Brian M. Kinney is a Clinical Associate Professor of Plastic Surgery at the University of Southern California in Los Angeles and a reputable board-certified plastic surgeon. Dr Kinney has served as President of the Plastic Surgery Educational Foundation of the US (PSEF), Chair of the Board of Trustees of the American Society of Plastic Surgeons (ASPS), Deputy Secretary General of the International Confederation of Aesthetic, Plastic and Reconstructive Surgeons (IPRAS), Board member of the American Society for Aesthetic Plastic Surgery (ASAPS), part of the International Society of Aesthetic Plastic Surgeons (ISAPS), Co-founder and member of the board of directors of the International Society of Plastic Regenerative Surgery (ISPRES), as well as Chair and Medical Director of Thermi. She was the founder and CEO of Galatea Surgical (now owned by Becton Dickinson), guiding the company from inception, through clinical studies and the commercial release of GalaFLEX© for soft tissue reinforcement. She was also the founder and CSO of TyRx (now Medtronic Infection Control), which commercialised antibiotic eluting products for the prevention of infection associated with indwelling devices. Over more than 20 years in the industry, Arikha has cultivated deep expertise in resorbable surgical products and the development of solutions to complications associated with implantable devices. Arikha is currently an investor and board member of several privately held medical companies and non-profit organisations. Prof. Marcos Sforza, MD Marcos Sforza is one of the most renowned lecturers and researchers in the realm of plastic surgery. Dr Alexandre Mendonça Munhoz, MD, PhD is Assistant Professor of Plastic Surgery, Breast Surgery Division of Plastic Surgery at University of São Paulo School of Medicine in Sao Paolo, Brazil, and a full member of the Brazilian Society of Plastic Surgery (SBCP). He participates as a guest member of the international consultants of Plastic and Reconstructive Surgery and Breast Journal since 2006.

In the period of 2010–2014, Dr Munhoz took over the role of a permanent member of the editorial board of the Annals of Plastic Surgery and the coordination of the National Commission of Breast Reconstruction of the Brazilian Society of Plastic Surgery.

Dr Munhoz currently has 27 scientific awards related to plastic surgery research, 145 published scientific papers, with 124 indexed in PubMed platform, 93 publications as a first author and in the area of aesthetic and reconstructive breast surgery, which resulted in about the 2967 citations with an H-Index of 29.

In 2013, he became Head of the Breast Reconstruction Department of the Cancer Institute of São Paulo (ICESP). In 2015, Dr Munhoz took over the Department of Plastic Surgery of the Moriah Hospital. In 2016, he was elected by American Society of Plastic Surgery (ASPS) as Associated Editor of Plastic and Reconstructive Surgery Global Open Journal. Dr Dennis Hammond, a board-certified plastic surgeon by the American Board of Plastic Surgery, is one of the world’s most recognised and respected authorities in breast aesthetic and reconstructive surgery. He is a member of and has served on numerous committees for the American Society of Plastic Surgeons (ASPS) as well as for the American Society for Aesthetic Plastic Surgery (ASAPS), and is a member of the prestigious American Association of Plastic Surgeons.

Dr Hammond has co-edited one of the most influential textbooks in plastic surgery along with his friend and colleague Dr Scott Spear from Georgetown University in Washington DC. He has authored many scientific papers, and serves as a reviewer for scientific articles for Aesthetic Plastic Surgery, Plastic and Reconstructive Surgery and the Journal of Aesthetic Surgery.

Dr Hammond wrote the “Atlas of Aesthetic Breast Surgery”, first published in 2009, a book which became a gold standard on how to perform new and innovative techniques for surgically and artistically augmenting, reshaping, lifting and reducing the breast.

Dr Niamh Corduff qualified from Charing Cross Medical School, the University of London, in 1984 and subsequently did her basic surgical training in the UK before emigrating to Australia in 1988. Dr Corduff completed her specialist plastic surgical training in Melbourne, Australia, and in 1993, became a Fellow of the Royal Australasian College of Surgeons. With more than 2 decades of experience, this Australian surgeon is a member and former president of the Australasian Society for Aesthetic Plastic Surgery and an honorary member of the Australian Society of Plastic Surgeons. Dr Corduff developed a special interest in breast surgery and since 2000 her surgical practice was focused solely on aesthetic and reconstructive breast surgery. She has published and lectured on aesthetic breast surgery both locally and internationally.

Born in Spain in 1967, Dr Mayo holds a degree in medicine and surgery from Universidad Complutense de Madrid, a doctorate in research skills from Universidad Complutense de Madrid and a medical specialty in plastic aesthetic and reconstructive surgery since 2001, recognised by the UK. He is a member of the General Medical Council, validated in Switzerland and has professional experience in Zurich and currently in Madrid. 

He is the author of chapters in specialty books, and his works have been published in renowned journals, such as Aesthetic Plastic Surgery and Plastic and Reconstructive Surgery. Dr Mayo is an active member of the scientific society, including the Sociedad Española de Cirugía Estética y Plástica, the Asociación Española De Cirugía Estética, the International Society of Aesthetic Plastic Surgery and the American Society of Plastic Surgery. He is a reviewer for the Aesthetic Plastic Surgery Journal and has patented ideas applicable in breast implant manufacturing. He has completed over 12,000 surgical interventions as primary surgeon and has implanted over 10,000 breast implants in more than 20 countries around the world as part of conferences, Masterclasses and other scientific events.
